Insurance for Employees: How It Really Functions

Worker’s compensation — what is it?

For those unfortunate enough to sustain an injury while on the job, workers’ compensation covers both lost pay and medical expenses. Workers’ compensation insurance is a cost to employers. Workers make no contributions to the pension plan.

If the employer or insurance provider verifies that the injury or sickness was sustained in the course of employment, then workers’ compensation will be granted. A worker’s compensation judge rules on the matter if the insurer or employer denies the claim.

Workers’ compensation may provide financial assistance to a decedent’s family in addition to medical bills and rehabilitation costs incurred by the deceased worker.

Summary of Workers’ Compensation

In 1911, states began enacting laws and incorporating provisions for workers’ compensation into their constitutions.

There is now a workers’ compensation system in place in all 50 states plus DC.

All states except Texas and Wyoming require employers to have workers’ compensation insurance.

Workers’ compensation insurance is only sometimes required for farmers, domestic workers, or self-employed individuals.

The National Academy of Social Insurance report from November 2020 estimates total workers’ compensation payments awarded in 2018 at $62.9 billion.

So, what exactly does workers’ compensation cover?

Let’s take a deeper look at what workers’ compensation really pays for.

Workers’ compensation pays for all medical care, including trips to the hospital, prescription drugs, and emergency surgery.

If an employee is sick or injured on the job and has to take time off work to heal, the company will pay for some of their lost salary while they are off.

If the injury rendered you totally or partially unable to work, you may be eligible for disability compensation.

Workers’ comp will pay for any necessary follow-up treatment, such as physical therapy.

Survivor benefits and funeral expenses are standard components of a death benefit package.

It doesn’t matter who was at fault for the accident; the insurance company will still compensate the wounded worker. As for employees suing their employers for a work-related accident or sickness, this is often not possible due to workers’ compensation rules.

Is Covid-19 Included in Workers’ Compensation?

Workplace exposure to Covid-19 may qualify you for workers’ compensation, depending on your state and industry. The National Conference of State Legislatures has concluded that:

Seventeen states and the Commonwealth of Puerto Rico have passed legislation to add Covid-19 to the list of work-related illnesses covered by workers’ compensation.

Several state legislatures have passed bills mandating Covid-19 workers’ comp coverage for certain categories of employees—first responders and medical personnel only in Minnesota, Utah, and Wisconsin. States like Illinois, New Jersey, and Vermont have you covered no matter what you do. Workers in California and Wyoming get complete coverage.

Both the state of California and the state of Kentucky have taken administrative action to expand healthcare coverage to include workers in the grocery industry.

What Doesn’t Covered by Workers’ Comp Insurance?

Employees are eligible for workers’ comp regardless of how many hours they actually work.

Your workers’ compensation claim may be denied, though, under certain circumstances.

Commute time is often not covered by workers’ compensation. Travelling salespeople and others who work outside of a traditional office setting may be eligible for coverage.

Many states’ workers’ compensation laws specifically exclude cases where intoxication or drug misuse had a role in the accident.

Workplace altercation: workers’ comp may not pay for injuries sustained in a fight with a coworker. Unless, of course, the dispute included the job.

Worker’s Compensation Insurance: Where to Buy

Need to cover your staff with workers’ comp insurance? Depending on where you live, you can acquire workers’ compensation insurance either from a commercial insurance company or a government-run agency.

The rates and acceptance of clients are both under the purview of the individual private worker’s compensation insurance firms. Private insurance may be less expensive than state-run alternatives.

When private insurers refuse to provide adequate workers’ comp coverage, it may be worthwhile to investigate publicly supported alternatives.

Private insurers and state-run programs both compete for clients in a state-funded workers’ comp system.

When a state runs a single workers’ comp program, private companies have no option but to enrol in it for workers’ comp coverage. States like Ohio, North Dakota, Washington, and Wyoming have completely state-funded

What is the average cost of workers’ compensation?

The workers’ compensation premiums that businesses pay depend on the riskiness of the jobs their employees hold. High-risk occupations include those in the construction industry or as an electrician. Police officers, firefighters, loggers, and those who engage in telecommunications maintenance are also at significant risk.

Workers’ comp rates also take into account the company’s payroll and any claims that have been made in the past.

According to The Hartford, the average premium for workers’ compensation insurance is $1 per $100 of payroll. The average varies widely from one state to another.

The cost of workers’ comp insurance is determined by how many people are insured, according to Andrew Dalton, associate vice president of Hartford’s small commercial worker’s compensation line of business. It is common practice for states to mandate that all workers’ compensation insurers conduct annual audits of premiums.

Dalton adds, “It’s crucial to make assured that the company owner is accounting for their personnel throughout the year, and it’s important to keep in mind that this audit is necessary.”

If premiums were over or under-collected or were exactly right, the audit will reveal it. It also calculates the premium for the next year. A company’s workers’ compensation premium may go up or down depending on the outcome of the audit.

Instructions for Filing a Worker’s Compensation Claim

Workers’ compensation claims begin with the employee informing their employer that they have been unwell or injured while on the job.

The next step is for the company to inform the insurance company and, if necessary, the state workers’ compensation board.

To comply with OSHA regulations, businesses must record work-related fatalities and catastrophic injuries.

If a company doesn’t think an employee’s injury or sickness was brought on by their job, they might contest their workers’ comp claim. In order to get workers’ compensation payments, the employee may have to argue their case in front of a workers’ compensation board.

Management of Workers’ Compensation Claim Risks

Managing your company’s exposure to workers’ compensation claims is one way to maintain a handle on premium costs in the future.

“There’s a lot that can assist an employer in managing the risk of employee injuries,” adds Dalton. “You don’t want to leave these things to chance; you want to make assured that you have safety rules and processes and that your company has made efforts to limit the kind of things that might cause damage.”

Employee safety training is an effective method for reducing workplace accidents and injuries. Discounts on workers’ compensation insurance are available in several states if an employer enacts a comprehensive safety program in the workplace.

Possible components of this safety program are:

  • Documented guidelines for ensuring worker safety
  • Verifications of Security
  • Upkeep Preventative
  • Protective Measures and First Aid
